Nebraska Citizens' Elections Bill of Rights

Nebraska elections belong to Nebraska citizens. Every eligible citizen should be able to cast a lawful ballot with confidence that Nebraska's elections are accurate, transparent, independently verifiable, and protected from foreign interference, technological vulnerabilities, and improper influence.

I. Nebraska Elections Are for U.S. Citizens
 

• Nebraska's Constitution already establishes U.S. citizenship as a qualification to vote. 
   

• Nebraska should verify citizenship when voters register and conduct lawful, ongoing citizenship verification of existing voter rolls using available state and federal records. No eligible citizen should be improperly removed, and confirmed ineligible registrations should be addressed according to law.

• Foreign money and foreign control should have no place in Nebraska elections.

II. Photo Identification for Every Vote
 

• Nebraska voters amended our Constitution in 2022 to require photographic identification, and voter ID has been required statewide since 2024.
  ​

• Nebraska should continue strengthening voter identification so election officials can reliably establish the identity and eligibility of every voter while protecting every qualified citizen's right to vote.

III. Restore Election Day as Election Day
 

• Election Day should again be the center of Nebraska elections.
   

• Early voting should be limited, and absentee voting should serve voters with legitimate needs. Ballot eligibility and identification should be verified before ballots are counted, with transparent processing and timely reporting of results.

IV. Accurate Voter Rolls
 

• Nebraska should continuously verify the citizenship, identity, residency, and eligibility of registered voters within the limits of federal and state law.
  ​

• List-maintenance procedures should be transparent and auditable, and election officials should act on credible information identifying potentially inaccurate registrations.

V. Paper Ballots, Not Black Boxes

• The ballot marked by the voter should be the authoritative record of the vote. Nebraska elections should never depend upon proprietary systems that citizens cannot independently inspect or verify.
   

• Election technology should have no internal modems or remote-access capability. Any technology used in Nebraska elections should be subject to meaningful public scrutiny, public testing, and independent verification.

VI. Verify Before Certification
 

• Before an election is certified, Nebraska should reconcile voters, ballots, and votes and independently verify the reported results against the paper ballots.
   

• Post-election audits should examine the actual ballots, not simply repeat the same computerized process used to produce the original count.

VII. Elections Belong in the Sunshine
 

• Election administration, ballot processing, and tabulation should be open to meaningful observation.
   

• Election records should be preserved and made publicly available to the greatest extent permitted by law, with personally identifiable information protected.
   

• That should include chain-of-custody documentation, ballot images, cast vote records, and other election records necessary for Nebraskans to examine how their elections were conducted, with personally identifiable information protected.

VIII. Protect Nebraska's Military Voters
 

• Nebraska should make certain that service members defending our country can vote securely wherever they are deployed.
   

• Military voters should not simply be treated as interchangeable with every other category of overseas voter. Procedures should recognize the unique circumstances of active-duty military service while maintaining appropriate identity and eligibility safeguards.
   

IX. Preserve Nebraska's Constitutional Election System
 

• Nebraska should protect one-person, one-vote elections and reject systems that unnecessarily complicate voter intent or determining the winner.
   

• Nebraska should reject ranked-choice voting and efforts to circumvent the Electoral College through the National Popular Vote compact.
   

X. Election Laws Must Be Enforceable
 

• Election laws are meaningful only when they can be enforced.
  ​

• Nebraska should provide clear accountability when election laws are violated, meaningful remedies when election records are unlawfully withheld or destroyed, and appropriate mechanisms for citizens with a concrete legal injury to seek enforcement.

Nebraska elections should be simple to understand, transparent to observe, and possible to verify without asking voters to blindly trust government or technology.

​

Every eligible Nebraska citizen should be able to vote. Only eligible citizens should vote. The ballot marked by the voter should remain the ultimate record, and Nebraska should always be capable of proving its election results from those ballots.
